Terms of Service

Draft terms for Adverciser’s attention marketplace. Not legal advice — counsel should review before production.

These Terms of Service (“Terms”) govern your use of Adverciser’s apps, websites, and related services (the “Services”). By creating an account or using the Services, you agree to these Terms and our Privacy Policy.

1. What Adverciser is

Adverciser is an attention marketplace. Buyers fund campaigns so real people can explore linked content and provide feedback. Advercisers earn for eligible completed explorations — not for forced likes, follows, downloads, or fake engagement.

2. Eligibility

You must be at least 18 years old (or the age of majority where you live, if higher)
You must provide accurate registration information
One person should maintain one primary account unless we expressly allow otherwise
You are responsible for safeguarding your login credentials

3. Accounts and roles

An account may use the Adverciser role (explore & earn), the Buyer role (create campaigns), or both when enabled. You must complete required profile steps before accessing role-specific features.

4. Adverciser rules (explorers)

Explore content in good faith using the in-app flow for the required minimum time
Submit honest feedback; do not spam, copy-paste nonsense, or use bots
Do not attempt to claim or complete opportunities you are not eligible for
Respect daily completion limits and preference-change cooldowns that protect marketplace quality
Optional further actions suggested after feedback are never required for payment

5. Buyer rules (campaign creators)

Provide lawful content links and accurate campaign details
Target only with allowed audience signals (interests, soft age ranges, location). Do not request sensitive targeting
Pay campaign costs through our checkout before activation
Do not use the platform to run scams, malware, adult/illegal content, hate, or deceptive offers
Campaign results are privacy-safe summaries and feedback — not a surveillance product

6. Campaigns, pricing, and payment

Buyer prices and explorer payouts are shown in the app and may change over time. Campaigns may be paused, resumed, cancelled, completed, duplicated (“Run again”), or boosted according to product rules. Buyer payments for campaigns are generally processed by third-party processors (for example Stripe). Fees, taxes, and currency conversion may apply as disclosed at checkout.

7. Earnings and payouts

Eligible completed tasks may credit your in-app wallet. Wallet balances are not bank deposits. Withdrawals are subject to our Payout Policy, minimum thresholds, identity/payment checks, fraud review, and applicable law. We may reverse or withhold credits for invalid, abusive, or policy-violating activity.

8. Prohibited conduct

Fraud, multi-accounting, VPN/device farms used to game matching or payouts
Scraping, reverse engineering, or interfering with the Services
Harassment, illegal content, or infringement of others’ rights
Misrepresenting campaigns, earnings, or platform capabilities

9. Intellectual property and feedback

Adverciser owns the Services, branding, and software. Buyers retain rights in their campaign content subject to the license needed for us to display and deliver campaigns. Feedback you submit may be shown to the relevant Buyer in privacy-safe form and used to operate and improve the Services.

10. Suspension and termination

We may suspend or terminate access for violations, risk, legal reasons, or prolonged inactivity. You may stop using the Services and request account deletion as described in the Privacy Policy.

11. Disclaimers

The Services are provided “as is.” We do not guarantee uninterrupted availability, a particular number of opportunities, fill rates for campaigns, or any specific earnings. Opportunity volume depends on buyer demand, matching, and quality controls.

12. Limitation of liability

To the fullest extent permitted by law, Adverciser is not liable for indirect, incidental, special, consequential, or punitive damages, or lost profits, arising from your use of the Services. Our aggregate liability for claims relating to the Services is limited to the greater of (a) amounts you paid us for Buyer services in the 3 months before the claim or (b) USD $100, except where law forbids such limits.

13. Indemnity

You agree to defend and indemnify Adverciser against claims arising from your content, campaigns, misuse of the Services, or violation of these Terms or law.

14. Changes

We may update these Terms. Continued use after updates become effective means you accept the revised Terms. If you do not agree, stop using the Services and delete your account.
